Executive Summary: | |||||
The liquor license process begins at the State level and applications are then forwarded to the respective municipality for posting of the property and holding a public hearing, after which the Council recommendation is forwarded back to the State. A Series 12 license allows the holder of a restaurant license to sell and serve spirituous liquor solely for consumption on the premises of an establishment which derives at least forty percent (40%) of its gross revenue from the sale of food. The property has been posted as required, and the Police, Community Development, and Sales Tax divisions have reviewed the application with no concerns noted. A representative from Grimaldi's Pizzeria reached out to the City Clerk's office on March 21, 2016, about their liquor license and communicated that they were trying to open for business the first part of May. Staff explained that the application had not yet been received and the deadline to receive the application and payment to get on a City Council agenda prior to the beginning of May would be March 30, 2016. The application was received from the State on March 24, 2016, at which time staff contacted the agent listed on the application and informed them of the required fees and the deadline to receive them. There was no further communication until the required payment was received in the Clerk's office on March 31, 2016, when staff called to inform the agent on the application that the deadline had been missed. There is a legal requirement to post a hearing notice 20 days in advance of the hearing, due to the delay in receiving the fee the deadline to post the notice for the April 19, 2016, meeting passed and the location was posted for the Council meeting of May 3, 2016. |

Approval of this contract will allow the purchase of the Toro Groundsmaster 5910 Mower through Simpson Norton of Phoenix , Arizona. This equipment is utilized by the Parks Section in the maintenance of fifty four (54) acres of turf within parks and cemetery on a weekly basis. With the Recreation programming and field rentals on the athletic fields there is an expectation that the fields will be properly maintained. Cooperative Purchasing Agreements between Mohave Educational Services and its members, like the City of Flagstaff, have been established under the Arizona procurement rules and code for use of contracts. |

The Toro Groundsmaster 580D Mower was purchased in 1999 and is now 17 years old. Its useful life was extended beyond its 10 year replacement date because of two refurbishments. It has been determined by Fleet Services that this is no longer a viable option because of the increased cost of maintenance and downtime associated with its maintenance. This equipment is used in the maintenance of 54 acres of turf within the Parks and Cemetery on a weekly basis. With the Recreation programming and field rentals on the athletic fields there is an expectation that the fields are properly mowed. During the months of July through September, the fields are mowed twice a week. In October 2014, Parks presented to the Fleet Committee asking for the replacement of the Toro 580D Groundsmaster mower that is used on the BBB Rec Fields. This request was approved by the committee at that time. Parks has carried forward funds from consecutive fiscal years FY14, FY15 to build up the reserve to secure the purchase. Additional funds have been budgeted in FY16. |

Background/History: | |||||
The Flagstaff Police Department considers any loss of life or limb to a drug or alcohol-related, motor vehicle accident unacceptable. We have conducted both in-service and advanced officer training in D.U.I. detection. We have a longstanding tradition of aggressive D.U.I. interdiction and enforcement. This is done in the interest of protecting life and property through collision reduction. Our interdiction efforts have further been supported with D.U.I. overtime operations such as task force patrols, and directed patrols on weekends and holidays. These efforts are staffed by officers on overtime to enhance effectiveness. Without the financial resources provided for by DUI Task Force grant application, it is difficult, if not impossible, to staff these operations with on-duty officers as they have primary responsibility to respond to all manner of calls for service during their shift. The Youth Alcohol Prevention and Interdiction grant application fits in with our mission to protect and preserve life and property. The Flagstaff Police Department has a zero tolerance policy towards alcohol-related crimes including: driving under the influence, minor consumption, misrepresentation of age to purchase alcohol, and contributing to the delinquency of a minor. Related to these ends, the FPD expects each of its patrol officers to proactively engage in the arrest of liquor violations. Flagstaff Police Department officers are typically attached to patrol squads that work during the evening and night time hours. During their shift, these officers are responsible for answering calls for service while remaining vigilant for alcohol violations. However, we feel that we have the potential to be even more effective and have a greater impact in the area of underage drinking enforcement during known times and locations when these types of violations are more likely to occur. Our proposal concerns the granting of overtime reimbursement funds for directed patrol efforts for the enforcement of underage drinking laws, as well as an educational component. The Flagstaff Police Departments grant application includes the purchase of two police motorcycles and six modular helmets. Studies of accident causes within the City of Flagstaff have historically shown speed not reasonable and prudent as the most frequent causal factor of collisions. Increased enforcement of speed statutes benefits the public by directly addressing the primary cause of accidents within our community. The most efficient way to enforce these statutes is through the use of a designated traffic enforcement program; these police motorcycles will directly assist the officers in lowering the number of speed related accidents. This in turn would result in better protection of life as well as a reduction of injuries and property damage from speed related collisions. | |||||

The law-abiding citizens of our community expect and deserve our streets and neighborhoods to be places where they feel safe. The approval of these grant applications will allow us to seek additional resources to help us reduce collisions through removing impaired drivers, underage alcohol prevention/education, and reduce speed related collisions with the use of the traffic enforcement unit. The CFRA is a long-standing Agreement between the City and AZ State Forestry, renewable every two years. The current CFRA expired March 30, 2016, but was extended until this new CFRA was provided by the State and ready to be acted upon by the City. The CFRA allows the City to participate in inter-agency emergency events and response activities outside the City (when assistance is requested by either the State and/or Federal government) and to recover 100% of all equipment and personnel costs associated with such action. At no time does our involvement with the CFRA diminish our staffing and/or capacity to provide service to the City. | |||||

In June this year the US Supreme Court rendered its decision in the Reed v. Town of Gilbert sign code case which clarified when government regulation of speech is content based. Content-based laws are presumptively unconstitutional. The Supreme Court's decision in the Reed case has wide-ranging implications for sign ordinances in cities across the nation.

The proposed amendments to Division 10-50.100 (Sign Standards) are intended to ensure consistency with the US Supreme Court’s decision, and to streamline, simplify, and improve the standards to provide flexibility and maintain a positive community image, while supporting the needs of business owners. Resolution 2016-13 (2016 Amendments to City Code Title 10, Zoning Code, Division 10-50.100 (Sign Standards) and Other Related Divisions) is attached. This is a “Clean” version of the amendments to the sign standards and other related Sections of the Zoning Code with all changes accepted to assist in the Council's review, except that recent revisions proposed after further legal review have been inserted in Track Changes format. This version has been reorganized into a more logical structure, cross references and formatting are completed, and it is a final version. A “Track Changes” version of the draft amendments that shows new text in underline and text to be deleted in The majority of the amendments included within this Division, especially in the Portable Signs Section (formerly Temporary Signs), are proposed in response to the US Supreme Court’s decision in the Reed v. Town of Gilbert sign code case to ensure that the City’s sign provisions are content neutral. INFORM, CONSULT, and INVOLVE Once a preliminary draft of the proposed amendments to the Sign Standards was completed, staff has engaged with members of such local organizations as Friends of Flagstaff’s Future, Northern Arizona Builders Association, Northern Arizona Association of Realtors, and the Flagstaff Chamber of Commerce Economic Development Committee to solicit their comments and reaction to the amendments. Also, a number of articles were published in the Flagstaff Business News and Cityscape, and staff has participated in frequent interviews on KAFF Radio. Consistent with state law and the requirements of the Zoning Code the Planning and Zoning Commission held a work session on the proposed sign code amendments on February 10, 2016. No residents were in attendance and no comments were provided to the Commission. The Council also held a work session on December 8, 2015 on the proposed amendments at which time general policy direction was provided to staff. No residents spoke to the Council at that work session. In advance of all Council and Planning and Zoning Commission work sessions as well as the Commission’s February 24th public hearing, staff has sent out an email to local stakeholder organizations such as Friends of Flagstaff’s Future, Northern Arizona Builders Association, Northern Arizona Association of Realtors, and the Flagstaff Chamber of Commerce Economic Development Committee. These groups were requested to forward the email to their members. Interviews with KAFF radio have also been scheduled regularly, and posts to the City’s Facebook accounts have been posted. Further, in compliance with state law and the Zoning Code’s noticing requirements, a ¼ page display advertisement (larger than the minimum required 1/8 page ad) was printed in the Arizona Daily Sun in advance of all public meetings and public hearings of the Planning and Zoning Commission and the City Council. About six members of the public attended the Planning Commission's February 24th public hearing, but none chose to speak to the Commission. At this meeting the Commission unanimously recommended that the Council approve the amendments to Division 10-50.100 (Sign Standards) attached to Resolution 2016-13. |
