STAFF RECOMMENDED ACTION: |
Approve the final plat with no conditions and authorize the Mayor to sign both the plat and City/Subdivider Agreement when notified by staff that the documents are ready for recording.

Executive Summary: |
This is a request for final plat approval for a 50-unit residential condominium subdivision known as Woodshire on Butler Condominiums. Please see Sheet No. 1 of the Final Plat for the Vicinity Map. Since its initial approval on November 5, 2019, staff has identified that Tract B was incorrectly dedicated to the City. This Final Plat application fixes the dedication error and dedicates Tract B to the HOA, with no other changes. This correction is important to comply with our code because the open common space for the condos must be maintained by the property owners and not the City of Flagstaff. This is being presented as a new Final Plat due to the fact that the City does not have a process for a Final Plat amendment. However, it should be noted that the dedication language is the only item being changed on this plat. The approximately 4.06-acre site is located at 2989 E. Butler Avenue in the HC, Highway Commercial, zone and 3001 E. Butler Avenue in the HR, High Density Residential, zone; both are in a Resource Protection Overlay (RPO) zone. |

Background and History: |
The Final Plat for Woodshire on Butler was approved by City Council on November 5, 2019. Staff has since identified that Tract B was incorrectly dedicated to the City of Flagstaff. Once the issue was identified, the applicant was advised to submit an application for a new final plat with the dedication language corrected to dedicate Tract B to the HOA. That is the only piece of information that has changed since this plat was approved in 2019.
The subject site is located on the south side of Butler Avenue just east of Herold Ranch Road. On July 2, 2019, the City Council approved a Purchase Agreement, a Preliminary Plat, and an associated Development Agreement; all requirements for the proposed development of this condominium subdivision which includes an affordable housing component. Civil engineering plans for the project were approved on August 12, 2019. On October 3, 2019, the Inter-Division Staff approved a Final Plat for the proposed development of 50 new condominiums and two tracts. The prior version of this Final Plat was approved by City Council on November 5, 2019. |

The City Council reviews final plat applications to ensure that the final plat meets the requirements of City Code Title 10, Flagstaff Zoning Code; Title 11, General Plans and Subdivision Code; and Title 13, Engineering Design Standards and Specifications. This amendment fixes an error in the dedication language when the Final Plat was approved in 2019, which incorrectly dedicated common open space to the City of Flagstaff instead of the HOA. |
