Consideration and Adoption of Resolution No. 2023-50: A resolution authorizing the execution of the Development Agreement between City of Flagstaff and VP 66 & Woody Mountain, LLC for Liv Timber Sky, related to the development of approximately 13.01 acres of real property generally located at 2445 S Woody Mountain Road. |

State law allows the City to enter into development agreements by resolution. The proposed agreement governs the terms and conditions for the development of the property including off-site sewer improvements, off-site roadway improvements including the proportional share of the new traffic signal, and sustainability standards. |

Key Considerations: |
A draft development agreement, attached to this report, has been prepared. The primary purpose of this agreement is to set out roles and responsibilities regarding the following (not limited to):
- off-site sewer improvements
- off-site roadway improvements including the proportional share of the new traffic signal
- sustainability standards including:
- materials management
- on-demand electric vehicle rentals
- electric vehicle charging
- bicycle parking
- electrified units
- pollinator friendly landscaping
- electric bicycles for short term rental use
