Mayor Evans called the meeting of January 10, 2017, to order at 6:00 p.m.

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the City Council and to the general public that, at this regular meeting, the City Council may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).

4. Public Participation

Public Participation enables the public to address the council about items that are not on the prepared agenda. Public Participation appears on the agenda twice, at the beginning and at the end of the work session. You may speak at one or the other, but not both. Anyone wishing to comment at the meeting is asked to fill out a speaker card and submit it to the recording clerk. When the item comes up on the agenda, your name will be called. You may address the Council up to three times throughout the meeting, including comments made during Public Participation. Please limit your remarks to three minutes per item to allow everyone to have an opportunity to speak. At the discretion of the Chair, ten or more persons present at the meeting and wishing to speak may appoint a representative who may have no more than fifteen minutes to speak.

The following comments were received:
  • The law is broken; a 50% increase in salaries in six months cannot be absorbed.
  • One third of employers will be laying off staff.
  • Daughter is a resident of Hozhoni Foundation and requires full assistance; if Hozhoni has to close they will have to leave Flagstaff to find a place for our daughter.
  • Son has cerebral palsy and Flagstaff has given him the best care he has ever had; if these businesses are shut down there will be no one to take care of him.
  • Caregivers are remarkable and deserve so much more than they receive but the funding is not available for these services.
  • There is a possibility that LouCorp will have to close because they are state funded and there are no plans to increase funding.
  • Urge the Council to look at the effects of this proposition and amend it.
  • Many depend on Quality Connections for job support, Goodwill for employment and LouCorp for housing. There will be no place for people with disabilities to live or work.
  • Please consider all of the people in Flagstaff who will be losing all they know and count on to live.
  • Proposition 414 is something that special service providers cannot withstand; this will close businesses because prices cannot be increased.
  • Tungland's lease expires in July and was renegotiated to opt-out early; they will be transitioning out of Flagstaff.
  • It is unethical to place the cost of living burden solely on businesses.
  • If there is no relief Hozhoni Foundation will lose 835 employees and 832 clients will be without services.
  • Voters did not understand the compounding effects of Proposition 206 and Proposition 414; remove the $2 higher requirement.
  • Hozhoni Foundation helps care for disabled sister; if that service is gone there is no place for her to go and there will be no continuity of care.
  • Please help and modify the law.
  • Flagstaff has some of the best programs for people with disabilities; if these programs go away many will have no choice but to move out of Flagstaff.
  • This situation is tearing this town apart.
  • Request Council to enhance the will of the voters, not reduce it.
  • Consider the people who have invested in themselves, gone to school and put in time to gain experience.
  • Abrio Care will have a headquarters in Flagstaff that provides no local services.
  • This is too much too fast.
  • The Council needs to examine and rebuild the infrastructure to allow these businesses to stay, especially the non-profits.

  Councilmember McCarthy asked if the Council will be discussing minimum wage at the City Council meeting next week. Mr. Copley confirmed that there will be a discussion at the 6:00 p.m. portion of the meeting.

Councilmember Barotz stated that most people are interested in the issue because they do not understand; she does not feel that the presentation is relevant to the problem. Mayor Evans stated that everyone in the audience has been following the Transect Zone issue but there are people in the audience that do not have the technical knowledge and staff is trying to provide that knowledge and understanding, however technical it is.

Vice Mayor Whelan stated that she has listened to the presentation and has a good grasp of what is going on; the issue is that there is a problem and it needs to be talked about. She appreciates that there are those who have not been able to participate but there are other means to bring them up to speed rather than take Council time. Mr. Kulina explained that he is trying to convey the framework of how the code came to be; it is broader than just transect and it is a broader knowledge that he is helping to covey.

Councilmember Barotz stated that some of the big projects that have been seen recently would have happened anyway and it is not the result of transect zoning. Mr. Kulina stated that transect zoning is not the reason for the large scale projects. Councilmember Barotz would like to relate that information in more practical terms; there is a lack of understanding on how the community is getting to these outcomes.

Councilmember Putzova stated that she would like to understand why compatibility is not considered in a way that the outcome would lead to what neighborhoods expect. She would also like to better understand the mass of the projects and what happens when parcels are combined. Lastly, she would like to understand if language in the Form-Based Code, that is not part of the standards, is legally enforceable. Councilmember Barotz stated that she would also like to understand the issue of combining lots and if it is infinite and how it plays into the equation of bulk and mass.

Mr. Kulina continued.

SCALE OF TRANSECTS

Councilmember Barotz stated that conventional and transect projects would be the same but the transect provides incentives so that the two may not always come out the same. Mr. Kulina offered parking as an example; parking is reduced in the transects but where parking is placed within a large, mixed use project is internal or underneath so there is no change in the form of the building. Councilmember Barotz offered that impacts to the community and the trade offs and incentives is another element for discussion.

The following comments were received:
  • Friends of Flagstaff's Future generally support the goals of density and walkability but they feel revisions are necessary.
  • Conventional zoning does allow for buildings that people may not like; maybe they should be looking at conventional zoning as well.
  • Defined dimensions for building forms and design guidelines that promote historic preservation.
  • Strengthen the requirement that parking restrictions only occur if there is adequate infrastructure available.
  • The ability to combine lots and or lack of lot depth are definitions that need calibration.
  • Height is determined by the underlying zoning.
  • Trade offs of parking reduction cannot be looked at in isolation.
  • A citizen group should be formed to provide ideas and feedback.
  • Update the table to include sub-zones.
  • Include metrics for lot size minimum and maximums and metrics for building body maximum width and depth.
  • Rename Commercial Block building to Main Street Mixed Use or Main Street Live-Work.
  • Language is so important, whether intentional or descriptive it is just as important as the tables.
  • The language of the code did not reflect the effort by the community.
  • Extra expertise is needed for traffic studies to better reflect reality.
  • Incorporate specific design standards into the transect zoning to preserve and enhance the historic integrity of the surrounding buildings.

In response to the public comment Mr. Kulina offered that when the code was written the consultants wanted to make the transect zoning as competitive to the conventional as possible so they looked to conventional standards to try and help conform and set those standards; they are not the same. Flagstaff was one of the first form-based codes written and the consultant has admitted that with each code they write there are lessons learned and those get applied to subsequent codes. The form-based codes that are written today look very different and Flagstaff can certainly apply some of those differences into its code. The Building Code Table is something staff has identified as well; it needs to be broken down into the sub-zones because it does not provide the clarification that is needed. Small, medium and large building types was another item that staff has discussed and is happy to discuss further; instead of having one building form that says commercial block maybe there needs to be varying types of commercial blocks so it can better reflect the intent. Additionally, specific design standards and how they impact historic properties was mentioned and is another item that staff has discussed; district specific design standards that would apply to all zoning, not just transect.  These are some of the ideas staff has been working on.

Councilmember McCarthy stated that when the code initially was adopted there was no discussion about what words in the code were and were not binding. He is optimistic about improving the code; there is a lot of work to do but he feels that the problems can be solved.

Councilmember Odegaard stated that improvements are needed in the transect code. He is interested in a citizen committee to work with staff to offer ideas, suggestions and reinforcement of what they believe is a good path forward.

Councilmember Putzova stated that there is a sense of urgency that the Council needs to do something right away. She suggested taking the transect part of the code off the table to hopefully provide incentive for the group to work quickly towards solutions.

Councilmember Barotz stated that issue of width for commercial block should be addressed right away as a way to ensure that the next project that comes through will not run the risk of an outcome that will shock people. The intent is to align community expectations with the implementation of the code. There are other issues in the code but they are not ones that have led to the outcomes people are surprised by. She asked if staff can identify some fixes that would help ensure there is not a project with a radically disappointing outcome because that is what the code allows.

Mr. Kulina offered that staff believes that there are some relatively quick and easy fixes to the code that will help it progress better. Some of those are establishing a maximum width, another one is coming up with a couple of new building types and telling where they are appropriate. There are some things that can further the intent language. That helps staff because they do not have discretionary powers when it comes to administrative reviews. If there is intent or purpose language that says to ensure project is compatible, staff has to rely on the standards that they assume were done to be compatible as the basis for that review. That is where the larger revision discussion begins; start with the purpose that outlines everything the code is supposed to accomplish then go to the smaller intent of each zone. There are some small fixes that help bridge the gap with larger amendments down the line to make sure the intents, purposes and preambles are truly being implemented in the code; that is something that would require staff and citizens getting into the nuts and bolts of the language.

Community Development Director Mark Landsiedel offered that staff could bring back text amendments rather quickly and alleviate the need to take the code off the table. It takes a lot of time to set up a citizen committee and formulate recommendations. Councilmember Barotz stated that the short term would be the urgent fixes to ensure there is not another Hub. It is reasonable to say that the community was upset on how it unfolded and there is an obligation to try and remediate that as quickly as possible. She would be supportive of staff bringing forward some changes with a citizen group coming later. 

Mr. Landsiedel asked for the Council to clarify the direction on the things they want to see staff bring back. Councilmember Barotz stated that staff's expertise will help drive that direction; she does not want another outcome like the Hub and staff can indicate what needs to change to avoid that.

Vice Mayor Whelan stated that the big table, dimensions on building types and the intent language are the areas that need immediate attention. Councilmember Putzova agreed stating that addressing the mass of the buildings is very important. She also requested information regarding the intent language and if it has any legal implication. Mr. Solomon explained that it is a legal question that would be best answered in a memo or executive session.

Councilmember McCarthy added that if the wording in the preamble is not binding it would be misleading to leave it there; if the intent is for that wording to be binding then it needs to be included in another area where it would confirm the intent. He also suggested that it may be helpful to get the perspective of the consultant on what they have learned since the Flagstaff code was developed.

Mayor Evans stated that the preamble is a legal question that needs to be clarified and pointed out that the Council did not vote on the preamble independent of the code. She believes that there are many in the community that have become experts on the City's zoning code and transect zoning and staff should utilize them in the citizen group. She offered that the consolidation of lots needs to be addressed as well as the connection to the Conditional Use Permit process. Additionally, the parking allowance needs to be addressed based on use.

Mr. Copley stated that he will work with staff and get the item back on an agenda as soon as possible.

PROPOSAL PROCESS

Councilmember Putzova asked for a performance update on the 2014-2016 priorities. Ms. Bloom explained that the City helped by providing operational assistance with Flagstaff Shelter Services. Flagstaff Shelter Services also did a Housing Case Manager Program which focused on getting clients from shelter into housing; it was a very successful program. The City also funded Flagstaff Shelter Services for their winter overflow shelters to make sure no one was turned away during Flagstaff's coldest months. Housing Solutions of Northern Arizona recently built a tri-plex in Sunnyside; it is a multi-family property with three units that are fully occupied. For Neighborhood Revitalization, $105,000 was designated for the revitalization of the Hal Jensen Recreation Center.

WHAT'S NEW FEDERALLY?
AFFIRMATIVELY FURTHERING FAIR HOUSING

Councilmember Putzova asked what the role of the Council is in the process. Ms. Bloom explained that it is up to the Council on how much they want to be involved. She is currently participating in numerous webinars and case studies to learn about what other communities are doing and the time it takes. The process involves getting into very meaningful details; talking to the school districts, looking at education, looking at barriers to access. Once there is a plan, staff will come to Council to report out and take suggestions. Housing Director Sarah Darr added that Council will ultimately approve the plan before it is submitted to HUD.

WHAT IS NEW LOCALLY?
COORDINATED ENTRY SYSTEM START UP

Mayor Evans asked how this ties in with the concept of crime free housing and people using that designation to deny people with criminal history access to housing. Ms. Darr explained that there will have to be a larger community discussion about the inherent incompatibilities that are found between the crime free multi-housing leases and overall inclusion. The current crime free multi-housing leases stand the way they do because individuals who have committed crimes are not a protected class. There have been multiple conversations with housing providers in the community and they acknowledge those inherent incompatibilities. The goal is to accomplish the goals that are important to crime free multi-housing and also create an environment where people overcoming past issues have a safe and stable place to live where they are not encountering former colleagues.

After discussion the Council agreed to the priorities of homelessness, housing, both rental and owner occupied, and neighborhood revitalization.
             
8. Discussion of Coconino County Ordinance No. 2016-08: County ordinance regulating the placement, storage and display of tobacco, vapor and electronic cigarette products for sale, and the use of vending machines related to the sale of tobacco, vapor and electronic cigarette products.
  Mr. Solomon addressed the Council and stated that the ordinance before them is a County ordinance. He explained that when the County passes an ordinance and there is an incorporated area within the County, such as Flagstaff, the city has the option to opt-in to the ordinance or opt-out with something more specific. This ordinance regulates the placement, storage and display of tobacco, vapor and electronic cigarette products for sale, and the use of vending machines related to the sale of tobacco, vapor and electronic cigarette products. It will prevent the storage of these items in areas that are accessible by those under the age of 18. The ordinance goes into effect on January 15, 2017 and the Council needs to decide how it would like to proceed. There is an exemption for businesses that require identification to gain entry to the facility.

Councilmember McCarthy stated that he feels that vapor products should be generally regulated the same way normal cigarettes are with the same restrictions as to where someone can smoke whether it is electronic or not. Mr. Solomon explained that the ordinance only pertains to display and storage but the Council could opt into the ordinance and address the usage and other issues separately.

The Council decided to opt into the County ordinance and asked for staff to bring a separate ordinance back to Council that aligns electronic cigarettes with normal cigarettes.
             
9.
Review of Draft Agenda Items for the January 17, 2017, City Council Meeting.*
* Public comment on draft agenda items will be taken at this time, at the discretion of the Mayor.
  Councilmember Putzova stated that at almost every Council meeting there are liquor licenses that are voted on. She requested to see how many licenses there are in Flagstaff, a map of where those licenses are located and possibly a year over year analysis. Additionally, it would be helpful to have some information to that effect in the staff summaries. Mayor Evans suggested clarifying if the liquor license is a new license, a renewal or a transfer and how many are currently active in Flagstaff.

Councilmember Odegaard asked if a discussion on Proposition 414 will be on the agenda for next week as he did not see it on the Draft Agenda. Mr. Copley explained that it will be included on the Final Agenda that will go out at the end of the week.
             
10. Informational Items To/From Mayor, Council, and City Manager; future agenda item requests.
  Councilmember Odegaard asked about the process of staff and Council at the upcoming retreat. Much of the presentation this evening on the transect zoning was unnecessary. He stated that there may be a loss of clarity of what staff is responsible.

Mayor Evans suggested that there could be a discussion regarding requests from the Council on Work Session items. She indicated that Council needs to be more specific in their requests for information to help guide staff with their presentations. Mr. Copley offered that he has heard the requests of Council and is working with staff on the new expectations of the staff summaries. That information has been communicated and it is a continuous learning process. He asked for some time and committed that the Council will see significant improvement in that area.

Vice Mayor Whelan requested information on conflict of interest with regards to people who want to serve on a board and they have a vested interest in that particular board. Mr. Solomon stated that he can get that information to her.

Mayor Evans stated that she went down to the opening session of the legislature and listened to the State of the State. While she was there she was asked about the annual breakfast that the City Council hosts with its legislative representatives to discuss priorities. She indicated that she would be interested in hosting another one of these meetings in the future.
